A Guide to Marriage in Turkey for Foreign Nationals

Legal Requirements, Validity, Grounds for Annulment, and Required Documents

Marriage in Turkey is a legal institution regulated under the Turkish Civil Code and is strictly subject to formal requirements. Although marriage resembles an engagement as a contractual relationship, it is established through a formal ceremony conducted before an authorized public authority and is directly related to public order.

For this reason, it is of particular importance for foreign nationals to be properly informed about both legal impediments and administrative practices when marrying in Turkey.

I. Legal Nature of Marriage

Marriage:

  • Is a legal contract established through the mutual and corresponding declarations of intent of the parties.

  • Unlike engagement, it is subject to a formal ceremony.

  • The declaration of marriage is made before a municipal marriage officer, civil registry officer, consulate, mukhtar (local authority), or provincial/district mufti.

  • The declaration of the authorized officer is declaratory, not constitutive.

Marriage is only possible between persons of opposite sexes.

II. Capacity to Marry and Age Requirement

  • Persons who are at least 18 years old, not under guardianship, and who possess discernment have full capacity to marry.

  • The minimum age for marriage is 16.

  • Persons under the age of 16 cannot marry under any circumstances.

  • Marriage of persons permanently lacking discernment is absolutely null and void.

A person who marries at the age of 16–17 with court permission becomes legally adult automatically. However, if such marriage ends, the person must reach the statutory minimum marriage age in order to remarry.

III. Impediments to Marriage

Absolute Impediments (Grounds for Absolute Nullity)

A marriage is absolutely null and void in the following cases:

  • One of the parties is already married at the time of marriage,

  • One of the parties permanently lacks discernment,

  • Existence of a mental illness constituting a legal impediment to marriage,

  • Prohibited degrees of kinship (direct line, collateral line, or in-law relations),

  • Marriage not conducted before an authorized marriage officer.

Relative Impediments (Grounds for Relative Nullity)

In cases of:

  • Temporary loss of discernment,

  • Error, fraud, or duress,

  • Marriage of a minor or restricted person without the consent of a legal representative,

the marriage remains valid unless an annulment action is filed.

IV. Non-Existence of Marriage

Marriage is deemed never to have been established in the following cases:

  • Same-sex marriage,

  • Marriage not conducted before an authorized marriage officer,

  • Absence of one of the parties during the ceremony.

In cases of non-existence, no annulment lawsuit is required; the judge may take this into account ex officio.

V. Required Documents for Foreign Nationals

Documents required from foreign nationals:

  • Birth certificate,

  • Certificate of single status (marriage eligibility certificate),

  • Original passport and photocopy,

  • Four passport-sized photographs,

  • Marriage health report,

  • Turkish Republic Identity Card (if available),

  • Sworn interpreter for those who do not speak Turkish.

For foreign nationals staying in Turkey for touristic purposes without a temporary residence card, an officially signed and stamped document showing entry and exit dates must be obtained from the Antalya Airport Passport Police Department.

Apostille and Translation Requirements

  • Citizens of EU countries may submit multilingual documents.

  • For citizens of other countries, birth and single status certificates must bear an apostille.

  • Apostilled documents must be translated into Turkish and notarized in Turkey.

For persons under international protection, a marriage eligibility certificate obtained from the Provincial Directorate of Migration Management is sufficient.

VI. Required Documents for Turkish Citizens

  • Four passport-sized photographs taken within the last 6 months,

  • Turkish ID card with marital status recorded and its photocopy,

  • Marriage health report,

  • Residence certificate, where required,

  • Parental consent and court permission for minors.

VII. Application and Ceremony Process

  • The parties apply jointly to the marriage registry office.

  • If the documents are approved, a marriage permit certificate is issued.

  • With this certificate, the marriage may be solemnized before any authorized marriage officer within 6 months.

  • After the ceremony, the marriage is registered, and a marriage booklet is issued.
